US Government’s medical marijuana patent

On the one hand, United States federal government officials have consistently denied that marijuana has any medical benefits. On the other, the government actually holds patents for the medical use of the plant.

Just check out US Patent 6630507 titled “Cannabinoids as antioxidants and neuroprotectants” which is assigned to The United States of America, as represented by the Department of Health and Human Services.
The patent claims that –

“Cannabinoids have been found to have antioxidant properties, unrelated to NMDA receptor antagonism. This new found property makes cannabinoids useful in the treatment and prophylaxis of wide variety of oxidation associated diseases, such as ischemic, age-related, inflammatory and autoimmune diseases.The cannabinoids are found to have particular application as neuroprotectants, for example in limiting neurological damage following ischemic insults, such as stroke and trauma, or in the treatment of neurodegenerative diseases, such as Alzheimer’s disease, Parkinson’s disease and HIV dementia.”

The patent was obtained in October of 2003.

Cannabinoids, for those who were wondering, are a group of chemical compounds found in marijuana that are also referred to as terpenophenolic compounds. One specific cannabinoid compound found in cannabis is tetrahydrocannabinol, more commonly known as THC. This substance gives marijuana its psychoactive effects.

The US government may hold this patent, but that will not stop their officials from consistently denying the benefits of medical marijuana. An FDA spokesperson, for instance, has claimed that “smoked marijuana has no currently accepted or proven medical use in the United States and is not an approved medical treatment.”I guess she didn’t get the memo.

It makes you wonder why the U.S. government is so unwilling to admit that marijuana has some valid medical properties. It seems unlikely that there is a popularity issue, especially when 60% of Americans believe that doctors should be allowed to prescribe marijuana. Maybe there are some lobbyists or bigwig campaign contributors that would get a little upset.

Since one part of the government applied for the patent of medical marijuana, and another part of the government approved that patent, it seems logical to conclude that the federal government knows that marijuana has some valid medical properties.

Now the hard part. How do we get them to admit it?

  1. How sad that information and studies would be ignored by major media for so long. Having watched as my amother in law die of lung cancer and all the while there were alternate approaches to treatment . They were hid.
    Does this surprise anyone that this country that once was the pride of the people and the envy of the Earth could fall so far from grace?

    • I feel ya. I watched my dear mom fight it for 17 years. The worst parts were chemo. 4 boughts. They would rather support big pharma and their harsh side effect treatments. We have Cannabinoid receptors in us. God gave us all the herbs.

      • What’s sad is people are so reliant on the main stream media. They think the media is supposed to be unbiased, sure in a perfect world. This is far from what the media is here in America. They have been shown to be the lap dog of the gov’t and big business. One can only guess as to how much money is spent on lobbying the gov’t on behalf of the huge pharma companies to keep the facts of marijuana hidden and obscured. The last thing big pharma companies want is a simple plant that can ease pain and in a lot of cases a cure for some terrible afflictions some cancers included. Think about it big pharmaceutical does NOT want a cheap cure. They are not interested in cures they want customers they can keep pumping manufactured drugs into at astronomical prices. I’ll say it again pharmacy companies DO NOT WANT CURES THEY WANT CUSTOMERS!

        • marijuana is not a cure for any cancer. I am a supporter of legalization, but making false claims about it are dangerous. Marijuana can help ease the nausea and symptoms but there are no conclusive studies that show it is a cure for any form of cancer

    • Government is up to their eyeballs involved in Marijuana ( and other drugs) so why would they want to legalize it ? Too much money going to Goverment (federal AND state) why would they want to stop that cash cow ? If I or my family needed it I say to hell with the law, I’m taking care of my family ! We DO need to get it legalized though so let’s keep their feet to the fire!

  2. We know its all about the money. Other countries have medical cures for things we are way behind on or literally prevented from knowing. If you have a mitrovalve prolapse for instance, you can get that fixed in France but not here. There is a cure for Diabetes in S. America but not here. If we were to actually approve something that would cure many diseases, or help people keep their immunity up while receiving the barbaric and archaic chemotherapy and radiation treatments, or even reduce CO2 greenhouse gases, those people who have become accustomed to their style of living would suffer. Marijuana is a plant, its level of mind alteration is not more than other herbs that are legal as herbal remedies (Melatonin, Kava Kava, Passionflower). Obviously, it is not about the truth of its safety or benefits, but more about the judgement placed on the people who use it and need it, and the loss of money to the FDA, insurance and drug companies, and Dr.s. This creates a problem, especially when patients who need or want Medical Marijuana when they ask their doctor. See most people with chronic pain have stopped seeing Dr’s for the very reason they are tired of being pumped full of many drugs that are very harsh on the body and cause a tyrade of side effects, something that herbal remedies do NOT do. The end result is usually a referral to a surgeon, not to a plant that affords them no kick backs. Dr.s are trained in Pharmaceuticals and their effects and will not recommend Medical Marijuana because it is not offered by a drug company that will give them a bonus for dispensing their medicine first. People with chronic pain are seeing chiropractors, acupuncturists, massage therapists, etc. because we address these issues much better than conventional medicine can and most people DON’T want surgery. This is a natural medicine, it should be available to any who choose it, it is better and more beneficial to our economy, environment and health than what we are currently doing. This has been proven. Its time to get up, stand up! Stand up for your rights! Dont give up the fight!

    • Celtic Healer, you wrote a very good report on Cannabis and the health care field. I’m a nurse of 30 years retired now dabbling in herbal remedies. Because of the Health care system and the rip off it is, not only are you right about the physicians and pharmaceutical companies but figure in the cancer hospitals they have built that would go under if they came up with a cure and marijuana was a part of that look at the billions of dollars lost to the medical world enough to let us all die rather than share. Nothing surprises me in health care I have seen more corruption in the medical field than in our judicial system if you can imagine that. I’m fighting as hard as I can to help make it legal but until they come up with a way to make enough money to cover the loss they have been covering we are in trouble. I can tell you the drug Marinol is the start of the government and the health care industry working on it. Good to hear from you and I’m in for the long haul!!

          • I am a human being… If I go to a Doctor, Who is the customer, who is the person providing a service for a fee? The old adage : The customer is always right. Doesn’t appear to be worth a flop anymore. I’m handed medicine because it has a side effect that may solve my problem, turns out that under smaller dosages it’s good for coughs, colds, sore holes, fits, farts, and freckles. Or it causes men to grow breast. Ladies waxing under their noses, Doctors know of more that they could do for us. “But if they told us they’d lose their license. They’re not allowed to tell us about stuff the upper crust stuffed shirts, don’t want us to know about. They messed up and backed research into the wrong direction and blew millions of dollars on seven different meds when one plant covers seventy kinds of complaints. My question is ? Do we need to keep paying into a system that is killing us on purpose with population control via medicine that doesn’t work. I’m really disappointed in our country.

            • Well said, Jerry. It is craziness and it makes me and others, sad, left with a feeling of being trapped in a maze controlled by people that are spiritually dead inside. I want the public to wake up, and say no, no, NO! People need to take back their power, but also, people need to realize that too many people still are living, willingly, from a brainwashed state. People are all too willing to accept any lie thrown their way, even if a voice from inside is screaming at them. Is that easier for most people, even with huge pain and personal loss? It seems so. I don’t see a solution, at least not yet. I try, every day, but I run into more opposition and apathy, and fear, than I do support or curiosity, enough to get the to read, watch a documentary, or just to contemplate that there is another filter through which to perceive. I tire of this issue. It is saddening.

      • FYI: marinol, a synthetic form of THC, has been FDA approved since 1985. Marinol is a schedule 3 drug. Meaning you don’t even need to see your doctor or have an “original” hand written/signed script like you do for ALL pain medications.
        The American Cancer society even says that marinol is MORE psychoactive than THC in its natural form (marijuana), and yet this is labeled a medicine, is tax exempt, is FDA APPROVED and used legally in all 50 states!!!!
        But they want us to believe that more studies need to happen to know if the natural version is safe… And the synthetic form has been on the market 30 years…
        So, either they approved Marinol withOUT needing “more information to its lasting effects” and I have lost ANY and ALL faith in our FDA approval/regulatory system, remind me again how many drugs they approved that could lead to death??? OR they are just blowing smoke up our butts about not knowing the effects to keep us from taking measures into our own hands and money away from BIG PHARMA.

        You decide. I’ve all ready made up my mind!!

        • It will take more than just those families. They have tried, many of them. It will take a majority of people to wake up to reveal these truths, before others will fight along side of them, to take back our power and to prove the truth about what has been done to “the people,” due to power hungry and controlling leaders and corporations and money hounds. It has everything to do with our entire history, of how the wrong people rise to the top, and the people buy into it, every single election day. Our system, all governments actually, don’t work, because of the type of people that are involved. Sane, smart, honest, humble, loving people, are not the ones involved. I do believe in a few that are/were in our government, but I can count those people on less than one hand. And three of them are now gone from the Senate. The American people must remember, we pay their paychecks. They work FOR us, supposedly, but in actuality, we hire them to work against our well being, and not having the truth about these cures, is the biggest holocaust in human history. Millions upon millions upon millions of people have suffered and died since the inception of this lie, more than a hundred years ago now.

  5. What worries me so much about the government holding patents for the medical uses of marijuana isn’t that one day people could have easy access to a natural wonder medicine. As it stands in my state, the people who use marijuana medically have access to it without fear of punishment or imprisonment.
    What worries me is the “friends” of the government. The companies/corporations that have patented other plants and then rob everyday citizens of their rights to grow that plant. What worries me further is the genetic modification of marijuana (beyond selective breeding) that will have the plant reach new potency that can be considered a hard drug – a really hard drug.
    Even more than all of that, I fear the drug becoming truly legal. Again, not because I don’t think people should use if they need. I fear legalization because once its legal and corporations have patents on it, there will be new, stricter, harsher punishments for patent infringement than there ever was for drug possession.

    Take for instance a medical patient who currently has a license to grow. He gets a few seeds from a friend who has been growing illegally, but shhh. So the patient grows his crop, harvest, takes what he needs and then takes the rest to a dispensary. That dispensary sells his crop…
    but oh no, in walks Mr. Corporate checker. He decides that he needs to make sure that the company he represents is not suffering a patent infringement… UH OH the seeds that the patient got from his friend were outside regulation, which shouldn’t matter, but this time it does, because those seeds genetic information was owned. So the Corporation decides that the Dispensary is in violation of federal law for selling a patented product without the proper licenses. Further more, the patient who grew it is also in trouble for cop right infringement because he did not purchase his seeds from the correct sources. Both will receive fines that will cripple them for the rest of their lives. As for the source of the seeds, the friend, well he is in the deepest poo poo of all because he had a patented product which he used to “make profit” whether he did or not is irrelevant, and also, he had a drug. So he is facing double the fines and jail time…
    Marijuana needs to be decriminalized for sure. People should not go to jail for possessing or consuming it. And small time dealers are a waste of time and energy to prosecute. But it should not be legal.

After my first back surgery was unsuccessful & the only releif was muscle relaxants, which kept me in a state of unstableness & unable to work my Neurosurgeon suggested Cannabis as some reliefe, it is a natural muscle relaxer & not addictive. Now I have to be a criminal to get reliefe and allow me to function.

    • Legalizing pot as a drug won’t directly make industrial hemp legal, especially if growing is controlled and licenses are only granted to those producing it as a drug. I could easily see this happen. Of course, the justification for illegal industrial hemp will be much weaker.

So the government lists it as a schedule I drug meaning it has no medicinal value among otber things, yet they grow it at the University of Mississippi and mail it to a select few in the states for medical purposes AND they hold a patent on it’s medicinal properties. Juicing Cannabis is like any other vegetable has health benefits that are out of this world, yet our government denies us the right to consume it. Susan Peskusky was on 40 different prescription drugs. She juiced Cannabis AND GOT OFF EVERY ONE OF THEM. Her doctors told her she couldn’t have kids. Now she has two. The government has known since 1974 that Cannabis kills cancer cells in mice. It prevents tumors from growing new blood cells, it prevents cancer cells from spreading, it makes cancer cells commit suicide, and it prevents cancer cells from reproducing. This has been proven with decades of research by people like Donald Tashkin of UCLA as well as a host of other doctors across the globe. It’s less addictive than coffee, has never killed anyone in the history of man, has zero side effects when used as medicine, and studies by UCLA, Harvard, and Brown University claim that Cannabis smokers, even heavy ones, have a reduced risk of cancer. It’s also proaptotic, which means it attacks cells that are in the process of dying so that they don’t become mutant or cancerous, and it leaves the good healthy cells untouched.

    And this natural plant is illegal almost everywhere. And people wonder why I’m passionate about this. We have been told for decades that we can’t possess this plant or grow it. The fact is, if anything, it should be a law that you have to grow it. The prohibition of Cannabis is a huge injustice to mankind and has costs millions of lives. Everything I posted is fact. Reviewing the patent to Hampson 6630507, his patent references demonstrates over and over how long the government has allowed big pharma to mine cannabinoids and reformulate into prescription drugs. This has been going on since the late 1960s almost immediatly afte the last of the Adams cannabinoid chemicsty patents awarded in 1950 moved into the public domain. These are all medical research based patent waards, hundreds of them/ wish I had time to run the record on all of them and list all of the diseases and symptoms the compounds targeted in these patents. What one sees is a true silver bullet that was purposefully supressed AND what appesars to be a case of intellectual property theft by the US government regarding the Hampson patent assigned to the the Dept of Health and Human Resources. For those that wish to see this, pull up Kuno PN 6563009 assigned to Virginia Commonwealth University awarded 5 months prior to Hampson even though Hampson had filed his application a full year and 3 months before Kuno and you will see the exact same patent, same content only the title, partent class/subclass, references and inventors names changed. Note that the first to file rule was not on the books at that time. I have only seen this in one other case where Oak Ridge Labs overpatented and individual back in the 1960s and changed the original inventors name to that of lab personnel without even bothering to reference the orignal inventor’s patent. The same thing occurred here, Hampson made no reference to Kuno. The only identifiable link in this case is Kuno’s coinventor Raj Razdan, one of the original cannabinoid researchers with multiple patents to his name over the years, his second patent award PN 3734930 “Direct Synthesis of Transtetrahydrocannabanol from Olivetol Trans Carnine Oxide”, May 1973 assigned to The Dept of Health, Education and Welfare which expired about 1988 so there is no way the gov could have claimed precident over Kuno based on this particular Razdan award. None of Razdan’s other patents were government awards. About 90% of big pharma’s prior cannabinoid art has expired. There seems to be reasonable cause to file suit against the government here to have the patent pulled down being the gov has been able to synthesize psychoactive cannabinoids form olive oil extracts for the last 40 years! Either ban olive trees and god knows whatever else natural its psychoactives have been synthesized from or legalize MJ and allow farmers back into hemp production and all its associated beneficial products.

Regardless of expressions of government ignorance, they will need to explain government agency assigned patents dating as far back as the early 1970s, ie 40 year old cannabinoid patents, now in the public domain for 20 years and the sheer volume of pharmaceutical patent awards for synthetic cannibanoids issued since 1968, many to the same drug companies that formerly sold cannabinoid based products before the 1937 ban.

    Oh – by the way – a plant can’t be patented. Not sure exactly what this patent covers, but it can’t cover the plant. You can do whatever you want with a plant.

    This is just like the government telling you that you’re not allowed to grow tomatoes or corn on your property. If they would try to tell you that, you’d simply shoot them in the face for preventing you access to food.

    Why is so difficult to make the LATERAL mental leap over to medicine? It’s a plant. You put a seed in some dirt, provide for its needs, wait…and receive valid medicine. It’s that simple.

    The fact that some silly men wrote some words on paper then put other silly men on the streets in silly costumes with a badge should not deter you from seeking, growing and using your own medicine in whatever way you see fit.

    Look, maybe you just need to realize that cannabis isn’t controlled by the government. You are. And, you’re a weak person with no spine for allowing that kind of control over your life and how you want to live it.   27. Patents of this sort are for extracts and synthesizing compounds. The first US government cannibinoid oil patent from the early 1970s covered the synthesis of cannibinoids from olive oil. Patents must divulge enough information and technique to allow anyone with reasonable skill to duplicate what is taught as a means of verification, meaning anyone or citizen can legally duplicate it and use it as they see fit as long as they do not enter into commerce with it..

    If you are going to quote it, quote it properly, it seems the word “Nonpsychoactive” was deliberately omitted from the quote to suit an agenda. This causes the article to lose credibility and the author is as guilty of the dishonesty that it casts on others.

Bud – Par for the course considering this patent was originally done by researchers at Virginia Commonwealth Univ, probably on government grant and immediately repatented essentially in its entirety by the government, doing little more than change inventor and assignee names to government researchers and US government.   36. The end of prohibition is approaching. The backlash will be tremendous. Pharmaceutical companies will lose massive profits and will lose their power and positioning over their VICTIMS.

    It is a crime to humanity to deprive man/woman of their natural right to consume anything put upon the Earth naturally, when no one’s person or property are being harmed in the process.

    As prisons become overcrowded in this nation which has the highest prison population in the world, changes will need to be made ad-hoc to the justice system to ensure the space to keep REAL criminals in jail. Not peaceful people deciding to exercise a natural right to choice.

OR…they bought the patent before the legalization began…because they knew they were going to tacitly approve legalization. The problem today is that you have an older generation who has had their behavior modified using traditional techniques on a nationwide scale to get them to think of marajuana as a very bad drug and act negatively towards it. Using and building on techniques known to cause racist thoughts, preemptive dislike of inanimate objects, illogical or clinical fear, and even taste ad version are the reasons pot has a bad name. Couple the decades of behavioral training on the old through radio and televisions with the purposefull shying away from science in schools that are still teaching the youth of the my generation who is now in college and you know why there is no advancement in non-synthetic, or curing medication. The government needs guaranteed money in the pharmaceutical industry to pay for it’s classified spending and military budget ad well as for the outrageous congress payroll. That is also why you see lack of teaching of real world, costly living subjects including civics, home economics, and other areas such as voting and personal finance in the majority of schools, especially poorer schools. If my generation, a generation currently twice the size of the baby boom generation, who have not been behaviorally modified to fit the “just pay the government and don’t ask why or make progress” mindset but rather been purposely taught to be laszy and not pay attention to “boring” topics lIke U.S. leadership and education, took charge we would see the real progress in medicine. This being especially true for the herbal medicines that no one seems to be doing intensive studies on as they do for pharmaceutical drugs.

  44. I could be wrong, but doesn’t it say in that particular patent that its for Cannabidiol? If so, that’s not actually marijuana, it’s a chemical found in all three species of the cannabis as well as a few other plants. Cannabidiol is related to tetrahydrocannabidiol (THC), closely related, but chemically they’re different enough that CBD (cannabidiol) isn’t psychoactive.

    • I’m pretty sure they are speaking of all cannabinoids – there are well over 80 known cannabinoids at this point.

      You may have seen the word “Cannabinoid” and thought it said “Cannabidiol” ? Easy to do.

  47. A person I know recently passed away from cancer. Which started as breast cancer. She went through chemo and radiation. Of course like always with cancer patients she was cleared. Less than a year after she was told she had cancer in her brain and other places. She passed as do all that have cancer and opt for chemo and radiation. It does not work and cost a lot of money! She had used marijuana for half her life. She died in her early fortys. Even though we know the chemo and radiation does not work I do not think marijuana is the answer for cancer.

After reviewing the patent scroll down to the references and click on each of the blue numbers to review other patents, the click on the blue “Referenced By” and review other patent citing this patent. It was Hurst who first helped to demonize it because of his industries in paper, newspaper & magazines. He saw the risk of his fortunes dwindling to nothing. Even our Constitution is written on hemp paper. Also, marijuana is not the proper name for it. Marijuana is actually a wild Mexican tobacco with no psychoactive properties whatsoever. They pegged it with this name so it could be called “Mexican devil weed”. When the first settlers came to this land England required the settlers to grow & provide the crown with so much hemp every year for paper, fabric, rope & sails for ships. Big business doesn’t want it around. Nixon knew from studies he had done that marijuana wasn’t addictive & has medicinal value. Then the government went to the national community & convinced all the countries to adopt the same laws against cannabis as the US so we wouldn’t find out. Valium, which comes from valerian. is addictive but widely used & available in its natural form, albeit smelly. I’ve even heard of hospitals using heroin for cancer patients. I’m sure they aren’t using stuff off the street, so they must be making it somewhere. Just like they’ve had a university growing marijuana for many many years. Then they sell universities the rights to study marijuana & sell them the marijuana from the government grow. Who’s the pot dealer here & just how much have they made off it so far behind our backs while telling us it’s not a medicine & locking people up for using & selling it? Another do as I say not as I do from our government.

I might be asking or saying a stupid comment but if patents are public records why couldn’t it be put on a site and blasted via the Internet, our government as good and strong as it may be is also very secretive and egotistical power hungry, so many things that have been said negatively about Marijuana and not one has ever been scientificly proven on the contrary the medical and health benifits from pain reducers to epelitic attacks controlled, it’s no secret that oil, hmo and pharmaceutical run this country, how much money would be lost by a product that has all this potential with NO side effects cause the medical industry and people who are ultimately responsible turn their head the other way while families struggle with finances and lost loved ones while others look away from the truth and strong possible cure for many of todays illnesses….I could go on and on

    Here are several post on here that indicate that a family member died from the very things that marijuana would cure, yet our government held back information that may have helped! My mother died from ALS, which marijuana has shown that it reduces the advance of the disease. In some cases they saw that it reversed the disease! There are THOUSANDS of people that could benefit from the use of marijuana! It has been found that marijuana can help seizure patients, the Israeli medics give marijuana to ALL head injuries! Marijuana is given immediately to back injuries and traumatic head injuries in the field! It prevents inter cranial pressure increases seen in traumatic head injuries! Further more, it kph as shown on MRI’S and CT’S to reverse the injuries and causes SOME rebuilding of the neural tissues!. it also shows promise in spinal injuries! Yet our government hides all of this info! WHY????? Because big business would lose money! Marijuana is cheap as hell to grow, the THC and CBD’S can be removes easily by shooting natural gas through the marijuana! It pulls out the THC and CBD’S , evaporates and leaves behind a wax like substance . The natural gas completely evaporates and leaves NO residue! ( Old hippy I know, is you take your old pipe, or bong and put alcohol in it, agitate it and it devolves the tar like substance left over , set in out in the sun and the alcohol evaporates and leaves behind a very potent residue! I was under the understanding that you can not patent a plant and thats why there is so much resistance to it as big pharma and government wouldnt have the monopoly on it…i found it strange that the 2003 patent said canibanoids and not medicinal hemp plant..i wonder if this was their fall back on or plan b that if legalization got passed them they would make a law that every plant you had to turn to oil they would tax you the canibanoids so they keep the good stuff inside and you can have the rest of the plant..if so we need a powerful barrister to face them in court to prove that the canibanoids are in fact a part of a plant and you cant patent plants..

  64. Patent #909554 was issued on Aug. 4, 2015, to a cannabis plant breeder in California, for a plant. Plants have been patented for hundreds of years, every since there has been a patenting system. Usually those plant patents are awarded to Monsanto and their ilk.

  65. Per US patent restrictions & guidelines the United States isn’t legally entitled to patient Marijuana because it is a naturally occurring substance/plant. The US Government has a deep conflict of interest here & obviously obtained this patient through applying undue pressure on gov officials/employees & from its own privileged, insider influence. The US gov did this so to obtain yet another tool for use against citizen & noncitizen alike for the purposes of: it’s own profiteering; & also to inflate, increase damages & intensify the severity of civil action & criminal charges it prosecutes.   66. Why have we not gathered signatures of people who have lost loved ones since 2003 when patent approved for these conditions. 1. I believe under law if a company hides or kept cures with money for research from gov they would be liable, and a government patent is by us all paid for by taxes. 2. All people convicted of marijuana charges who are disabled and claimed it helped on record should sue for money and time lost including as myself an100% se vice connect disabled war vet. Who on va records turned down Ptsd meds due to side effects in exchange for marijuana they took half my other meds away. So my and others similar paraphernalia charge lawyer fees fines etc. should be filed against us gov.

    You can not on one had say marijuana has no medical properties yet own parents for such properties by same government. Money is the only way to change it and since the pharmo cartels can buy votes we have to go the opposite we can’t match their money but if we sue for every lost life and dollar it would be such a large class action suit it could work and no one can block it. He’ll file it also through nafta free trade courts
